Real Estate transactional/litigation matters

Matt represents sellers, buyers, lessors, and lessees. We assist clients in resolving residential and commercial disputes and we zealously advise and guide buyers & sellers to achieve the client’s real estate goals. Matt has reviewed, drafted, revised, edited, and negotiated hundreds of leases, purchase agreements, easements, encroachment agreements, deeds, notes, and all other documents that are part and parcel in many Real Estate transactions. We resolve and/or litigate claims for breach of contract; failure to disclose material defects during residential purchases; encroachment/trespass, and the wrongful cutting down of trees.


Landlord-Tenant Law

Matt has represented commercial and residential lessors and lessees in disputes involving lease interpretation, declaratory relief, options, fair market value, breach of lease terms, and eviction.

  • Represented multiple sellers of commercial properties in 7 and 8 figure price range.

  • Represented Sellers of $16,000,000 San Francisco Commercial Property.

  • Represented Sellers of $10,000,000 San Jose Commercial Property. Sale was complicated by fact that property was used as assisted living facility. Matt associated with Sacramento firm for this transaction.

  • Represented Buyer of $7,000,000 Hayward property.

  • Represented Buyer of $5,000,000 Walnut Creek property.

  • Represented Sellers and Buyers of numerous San Francisco, Marin, and other Bay Area homes both with and without agent representation.

 Litigation matters have included the following exemplar cases:

  • A San Francisco restaurant that was denied the existence of a second option to extend a lease brought suit for declaratory relief and client obtained a substantial settlement from the property owner's insurance company.

  • Obtained $70,000 award for San Francisco couple against San Francisco Real Estate landlord who refused to return portion of clients' security deposit following lease expiration. Result included client's attorney's fees.

  • Represented a nationally recognized San Francisco architect in his claim against his neighbor following neighbor's addition that encroached on client's property.

  • Represented East Bay couple against neighbor who built carport over property line. Resulted in five figure settlement for trespass and encroachment.

  • Co-represented Marin County couple whose neighbor wrongfully topped/trimmed their trees resulting in $50,000 settlement.

  • San Francisco condominium owners in 2-unit building who made claim against seller for failing to disclose noise issue. Case settled following mediation.

  • Represented Buyers and Sellers in multiple failure to disclose cases arising from breach of California Civil Code Section 1102. Many cases also included claims or cross-claims against seller or buyer's broker/agent. Matt has also defended agents/brokers accused of failing to disclose.
